DEFINITIONS
1.1 The Company is Direct KBB Limited

1.2 The Contract is the agreement for purchase of Goods and/or for the Installation on which these terms are printed and of which they form part

1.3 The Goods are the Goods referred to in the Contract

1.4 The Customer is the person who has signed the Contract to buy the Goods and Services

1.5 The Price is the consideration stated in the Contract and payable by the Customer for the Goods and Services

1.6 The Property is the premises at which the Installation is to be made

1.7 The Installation is the supply and fitting of the Goods at the Property

1.8 The expression “Installation” does not include structural alterations, repairs or reinstatement unless expressly stated in the Contract

1.9 The Installation Date is the date or dates stated in the Contract

2 All the terms agreed between the Company and the Customer relating to the supply of the Goods and the Installation are contained in the Contract

3.1 The Company reserves the right to increase the Price by a reasonable amount if prior to commencement of the Installation it appears that the Installation will necessitate work or materials unforeseen at the date of the Contract

3.2 The increase shall be notified to the Customer in writing

3.3 Upon receipt of the notice the Customer shall have the right within 14 days to cancel the Contract by written notice to the Company

3.4 If you wish the work to commence within the cancellation period you must sign the start work now form. You can still cancel after signing this but you would be liable for the reasonable cost incurred by the company to the point of when the cancellation request is

4 The Company may change the specification of the Goods or the Installation if necessary to conform with any applicable safety or other statutory requirements

5.1 Following Installation the Company will make good any brickwork and plaster at the site of Installation provided that the existing surround is in good condition

5.2 The Company will not be liable to restore or redecorate any other part of the Property which has unavoidably been disturbed during the Installation or where the relevant part of the Property is in poor condition

5.3 Anything necessarily removed from the Property during the Installation will belong to the Company

6 The Price is inclusive of Value Added Tax

6.1 The Price shall be paid by the instalments set out in the Contract

6.2 The Company shall be under no obligation to supply the Goods or commence or complete the Installation if any part of the Price is due for payment but unpaid

6.3 If any part of the Price is due for payment but remain unpaid after fourteen days

6.3.1 The Company may treat the Contract as void

6.3.2 The company will charge for any reasonable costs incurred to the point of cancellation.

6.3.3 The Company shall be entitled to retain or remove (as the case may be) the Goods from the Property

6.4 The Customer will pay interest at 3% above the base rate for the time being of Yorkshire Bank plc on any part of the Price due but unpaid

7 Installation will commence on the Installation Date and the Company shall complete the Installation as quickly as is reasonably possible

8 The Customer shall, prior to the Installation Date, remove from the Property

8.1 all effects, fixtures and fittings in the vicinity of the Installation

8.2 any gas, electrical, plumbing, alarm or telephone equipment

9 The Customer will ensure that the Installation complies with any relevant legislation or regulations

10 The Customer shall permit the Company access to the Property at all reasonable times for the purposes of the Installation

10.1 The Customer shall not do anything or omit to do anything which would render the Property an unfit or unsafe working environment for the Company’s agents or employees

10.2 The Customer shall take all reasonable care for the safety of the Customer and of any third parties in the Property during the Installation

11.1 Risk of damage to or loss of the Goods shall pass to the Customer on the Installation Date

11.2 The Property in the Goods shall nevertheless not pass to the Customer until payment in full of the Price

11.3 Until the Property in the Goods passes to the Customer the Customer shall hold the Goods as the Company’s fiduciary agent and bailee

12 If the Company incurs any expenses in enforcing its rights and remedies against the Customer the Customer will incur the full legal costs.

12.1 Carcasses guaranteed for 10 years, doors and trims for 2 years and any plumbing fittings for 3 months after installation. Worktops guaranteed for 2 years, worktop joints are not guaranteed against water damage, e.g. expanding joints. Statutory Rights still apply under the Consumer Rights Act.

12.2 The Company shall be under no liability under the guarantee in respect of defects arising from fair wear and tear, negligent or excessive use, wilful damage, the effects of weather, or any misuse, alteration or repair of the Goods effected without the approval of the Company

13 The Company shall not be liable for any defect in the Goods arising from the use or application by the Company of any drawing design or specification provided by the Customer, other than that caused by our negligence.

14 All terms and conditions which would otherwise be implied in the Contract are to the extent permitted by law excluded

15 In the event of any breach of the Contract by the Company the remedies of the Customer shall be limited to damages and under no circumstances shall the liability of the Company exceed the Price

16 Guarantees/Warranties are not insurance backed

17 Complaints Policy: We always endeavour to provide the best service and products for our customers. However, on rare occasions, we recognise that there may be times where our customers may not be completely satisfied.

To ensure we are able to put things rights as soon as we can, please read our complaints

procedure below and we will respond promptly to ensure complete satisfaction.

As soon as possible after the completion of the works, please inspect the work to ensure everything has been carried out to our usual high standards.

or email us at customercare@directkitchens.co.uk and we aim to respond within 5 days of receiving your complaint and where possible, will provide you with a date to remedy any issues raised.

Where we are unable to resolve your complaint using our own complaints procedure, as a Which? Trusted trader we use Dispute Resolution Ombudsman for dispute resolution. In the unlikely event that we cannot remedy your complaint to your satisfaction you may wish to refer your complaint to them. If you wish to do so please contact Which?
